Last updated: 28 August 2026

These Terms and Conditions ("Terms") apply to the use of the Aged Care Capability Co. website, the purchase and use of ACCCo resources, and any associated products or services provided by Aged Care Capability Co. (ABN 85 184 982 132), referred to in these Terms as "ACCCo", "we", "us" or "our".

By accessing our website, placing an order, paying an invoice, downloading or accessing a resource, or otherwise using our products or services, you agree to these Terms.

If you are purchasing on behalf of an organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.

1. About ACCCo

Aged Care Capability Co. develops practical, evidence-informed education and clinical governance resources primarily for Australian aged care organisations and their workforce.

Resources may include facilitator guides, learner guides, workbooks, presentation slides, quick-reference tools, checklists, templates, case studies, knowledge checks, implementation tools, clinical governance tools, source lists and other educational materials.

ACCCo resources are designed to support workforce education, capability development, quality improvement and clinical governance. They do not replace organisational policies, procedures, professional obligations or individual clinical judgement.

2. Educational Use Only

ACCCo resources are provided for education, workforce development and organisational support purposes.

They do not constitute individual medical, nursing, legal, regulatory or other professional advice.

While ACCCo aims to provide accurate, relevant and evidence-informed information, aged care legislation, clinical guidance, standards, regulatory requirements and best-practice recommendations may change over time.

Organisations remain responsible for ensuring that the way a resource is used is appropriate to their circumstances and consistent with:

  • current legislation and regulatory requirements;
  • the Aged Care Quality Standards and other applicable standards;
  • professional standards and scopes of practice;
  • organisational policies and procedures;
  • current clinical guidelines;
  • individual resident or care recipient needs; and
  • appropriate clinical judgement and escalation processes.

Clinical decisions should always be based on appropriate individual assessment and should be made by suitably qualified health professionals where required.

3. Resource Purchases

Unless expressly stated otherwise, ACCCo resources are supplied as digital products.

When purchasing a resource, you are purchasing a licence to use that resource in accordance with these Terms. You are not purchasing ownership of the intellectual property contained within the resource.

The licence that applies to your purchase will be based on the product and number of sites selected at the time of purchase or stated on your invoice.

4. Site Licensing

ACCCo operates a site-licensing model.

A "site" generally means an individual aged care facility, residential service, care location or other separately operated service location using the resource.

A licence permits the purchasing organisation to use the purchased resource within the number of sites covered by the licence.

For example, a one-site licence permits use at one licensed site only. A multi-site licence permits use across no more than the number or range of sites included in that licence.

Where an organisation wishes to introduce a resource to additional sites beyond those covered by its existing licence, an appropriate licence upgrade or additional licence must be purchased before the resource is distributed or used at those additional sites.

Purchasing an ACCCo resource does not provide organisation-wide or unlimited-site rights unless the purchased licence expressly states that it does.

5. What a Site Licence Allows

Within the licensed site or sites, resources may generally be:

  • used to deliver internal staff education;
  • presented during internal education sessions;
  • provided electronically to staff for internal learning purposes;
  • printed for staff participating in education;
  • stored on secure internal organisational systems;
  • uploaded to a restricted internal learning management system where access is limited to personnel associated with the licensed site or sites;
  • incorporated into internal education programs;
  • referenced during internal quality improvement or clinical governance activities; and
  • reasonably customised to reflect local policies, procedures, terminology or organisational branding.

Reasonable customisation may include adding an organisation's logo, inserting local policy references, adding site-specific information or adapting activities for the organisation's workforce.

Any modification remains subject to these Terms and does not transfer ownership of the original resource or its intellectual property.

6. What a Site Licence Does Not Allow

Unless ACCCo has provided prior written permission, purchased resources must not be:

  • shared with unlicensed facilities, sites or organisations;
  • forwarded to another provider for their own use;
  • uploaded to a publicly accessible website;
  • placed in an unrestricted public file-sharing service;
  • published on social media;
  • sold or resold;
  • sublicensed;
  • commercially redistributed;
  • copied and repackaged as another organisation's commercial product;
  • provided as part of a resource library that is sold or licensed to third parties;
  • used to create a substantially similar competing commercial resource for sale;
  • distributed beyond the number of sites covered by the licence; or
  • used in a way that falsely suggests that ACCCo endorses another organisation, product or service.

Resources must not be systematically copied, extracted or reproduced for the purpose of creating a competing resource library, training product or commercial education service.

7. Internal Learning Management Systems

Purchased resources may be uploaded to a secure internal learning management system where access is appropriately restricted to staff associated with the licensed site or sites.

If an organisation operates a central learning management system across multiple facilities, the organisation is responsible for ensuring that access to ACCCo resources does not extend beyond the sites covered by its licence.

A resource must not be uploaded to a publicly accessible learning platform or unrestricted resource repository without written permission from ACCCo.

8. Intellectual Property

Unless otherwise stated, all intellectual property rights in ACCCo resources and website content, including copyright, remain the property of Aged Care Capability Co. or the relevant intellectual property owner.

This includes, without limitation:

  • written content;
  • resource structure;
  • facilitator guides;
  • learner guides and workbooks;
  • presentations;
  • templates;
  • graphics;
  • diagrams;
  • checklists;
  • frameworks;
  • educational activities;
  • reference tools;
  • website copy; and
  • branding.

Purchase of a resource grants a limited licence to use that resource in accordance with these Terms. It does not transfer copyright or intellectual property ownership to the purchaser.

Copyright, attribution, licensing or other proprietary notices included within a resource must not be deliberately removed for the purpose of representing the original ACCCo content as another party's independently created commercial work.

9. Individual Staff Use

Staff working within a licensed organisation may use resources provided to them for legitimate internal education and professional development purposes.

Individual staff members must not subsequently distribute blank copies, source files, presentations or other ACCCo resources to other organisations, facilities or individuals outside the licensed organisation.

Completed learner activities or workbooks may be retained by participants for their own professional learning records where appropriate.

10. External Facilitators and Consultants

Where a licensed organisation engages an external educator, facilitator or consultant to deliver education on its behalf, the organisation may provide reasonable temporary access to the relevant resource solely for the purpose of delivering education to the licensed site or sites.

The external party does not acquire an independent licence to retain, reuse, sell or distribute the resource to other clients.

11. Prices

All prices are displayed in Australian dollars unless otherwise stated.

Prices may vary according to:

  • the resource selected;
  • bundle size;
  • number of licensed sites;
  • promotional offers; or
  • other licensing arrangements.

Any applicable taxes or charges will be displayed where required.

ACCCo may change its prices from time to time. A price change will not alter the amount payable for an order that has already been accepted and paid unless agreed with the purchaser.

12. One-Off Purchases and Subscriptions

Unless a product is expressly described as a subscription, ACCCo resource purchases are one-off purchases.

There is no compulsory ongoing subscription fee required simply to continue using a resource that has been validly purchased, subject to compliance with the licence under which it was purchased.

Purchase of a resource does not automatically include future editions, major updates, newly developed resources or additional products unless expressly stated.

ACCCo may occasionally update resources and may choose to make an updated version available to previous purchasers, but is not required to provide future versions free of charge unless this formed part of the original purchase offer.

13. Orders and Payment

Payment must be made using one of the payment methods made available by ACCCo.

An order is not considered complete until payment has been successfully received or ACCCo has otherwise approved the order.

ACCCo reserves the right to decline or cancel an order where there has been:

  • an obvious pricing or listing error;
  • suspected fraudulent activity;
  • an incorrect licence selection;
  • inability to process payment; or
  • another reasonable issue preventing fulfilment.

Where an order is cancelled after payment has been received and ACCCo is unable to supply the purchased product, the amount paid for the affected product will be refunded.

14. Invoice Purchases

ACCCo may allow eligible organisations to purchase resources by invoice.

Where an invoice is issued, payment must be made by the due date shown on the invoice.

Unless otherwise agreed in writing, ACCCo may withhold delivery or access to purchased resources until cleared payment has been received.

Payment of an invoice constitutes acceptance of these Terms and the licence conditions stated on the invoice or associated order documentation.

Where a purchaser requires a purchase order number, supplier form or other procurement documentation, this should be arranged with ACCCo before payment or fulfilment where practicable.

Invoice enquiries may be sent to hello@agedcarecapabilityco.com.

15. Digital Delivery

Digital resources may be delivered by email, secure download link, file-transfer service, customer account or another reasonable electronic delivery method.

The purchaser is responsible for providing a correct and accessible email address and ensuring that their organisation's email, firewall or security systems permit receipt of the delivery.

If a resource has not been received within the delivery timeframe communicated at purchase, the purchaser should contact hello@agedcarecapabilityco.com.

Where delivery has failed because of an incorrect email address, spam filtering, organisational security settings or an expired download link, ACCCo will take reasonable steps to assist the purchaser to access the resource.

16. Download Links and Resource Security

Where ACCCo provides a secure or time-limited download link, the purchaser is responsible for downloading and securely storing the purchased resource within the permitted organisation.

Download links must not be publicly posted, published or deliberately provided to an unlicensed organisation or individual.

ACCCo may deactivate a link where there is reasonable evidence of unauthorised distribution, misuse or a security concern.

Deactivation of a delivery link does not, by itself, remove a purchaser's rights under the Australian Consumer Law.

17. Bundles and Build-a-Bundle Purchases

Where a purchaser selects a bundle containing a specified number of resources, the purchaser is responsible for confirming the selected resources before submitting the order.

The licence selected for the bundle applies to all resources included within that bundle unless otherwise stated.

Once digital bundle resources have been supplied, changes to resource selections because of a change of mind may be declined, subject always to any rights available under the Australian Consumer Law.

18. Refunds, Replacements and Australian Consumer Law

ACCCo does not generally provide refunds for a simple change of mind after a digital resource has been delivered or made accessible.

However, nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Where a product or service does not meet an applicable consumer guarantee, the purchaser may be entitled to a remedy available under Australian law.

Depending on the circumstances, this may include correction of the issue, replacement, re-supply, refund, cancellation or another remedy required by law.

If you believe there is a problem with a resource you have purchased, contact hello@agedcarecapabilityco.com with your order details and a description of the issue.

Requests involving duplicate purchases or other genuine purchasing errors may also be considered by ACCCo on a case-by-case basis.

19. Resource Accuracy and Currency

ACCCo takes reasonable care when developing its resources and aims to draw upon credible and relevant sources.

However, healthcare evidence, aged care regulation, legislation, government guidance, quality standards and professional recommendations can change.

Resources reflect information available during their development or most recent review and should not be assumed to remain current indefinitely.

Users are responsible for checking current legislation, regulatory guidance, professional standards, organisational policies and clinical guidance where relevant before relying upon a resource.

Where a resource contains references or links to external information, those external resources may be amended, moved or withdrawn without notice.

20. Clinical Responsibility

Responsibility for resident assessment, clinical decision-making, care planning, escalation, treatment, medication management and other clinical actions remains with the relevant organisation and appropriately qualified health professionals.

ACCCo does not:

  • assess individual residents or care recipients through its educational resources;
  • provide individual diagnosis or treatment recommendations;
  • replace medical or nursing assessment;
  • replace organisational clinical governance processes; or
  • guarantee a particular clinical, regulatory, accreditation or organisational outcome.

The use of an ACCCo resource does not remove an organisation's responsibility to exercise appropriate governance and professional judgement.

21. Regulatory and Accreditation Outcomes

ACCCo resources may assist organisations to educate staff about areas relevant to aged care quality, safety, governance and compliance.

However, purchase or use of an ACCCo resource does not guarantee:

  • compliance with every legislative or regulatory obligation;
  • successful accreditation;
  • compliance with the Aged Care Quality Standards;
  • a particular audit outcome;
  • avoidance of regulatory action;
  • avoidance of clinical incidents; or
  • a particular workforce competency outcome.

Organisations remain responsible for establishing and maintaining their own governance, compliance, education, competency assessment and quality systems.

22. Competency and Training Records

Completion of an ACCCo educational resource, workbook, knowledge check or training activity does not automatically establish clinical competency unless the employing organisation has appropriately assessed competency in accordance with its own requirements.

Organisations are responsible for determining:

  • which staff require particular education;
  • whether competency assessment is required;
  • who is authorised to assess competency;
  • how completion is recorded; and
  • whether additional practical training, supervision or assessment is necessary.

23. Third-Party Content and Links

ACCCo resources may refer or link to external websites, legislation, government resources, professional organisations, journal articles or other third-party material.

These references are provided to support learning and further reading.

ACCCo does not control third-party websites and is not responsible for changes to their content, availability, security or privacy practices.

Reference to a third-party organisation or source does not necessarily constitute endorsement, sponsorship or affiliation.

24. Limitation of Liability

Nothing in these Terms excludes or limits liability, consumer guarantees, rights or remedies that cannot lawfully be excluded or limited.

To the extent permitted by law, ACCCo is not responsible for loss arising solely because a purchaser or user:

  • used an educational resource as a substitute for appropriate clinical assessment or professional judgement;
  • failed to consider current legislation, standards, clinical guidance or organisational policy;
  • materially altered a resource in a manner that changed its intended meaning;
  • distributed a resource outside the scope of the purchased licence; or
  • used a resource for a purpose for which it was not reasonably intended.

To the extent permitted by law, ACCCo will not be liable for indirect or consequential loss arising from use of the website or resources except where such liability cannot legally be excluded.

25. Website Availability

ACCCo aims to keep its website and purchasing systems available and functioning but cannot guarantee uninterrupted or error-free access.

The website may occasionally be unavailable because of maintenance, technical issues, service-provider interruptions or circumstances outside ACCCo's reasonable control.

ACCCo may modify, discontinue or replace website features where reasonably necessary.

26. Prohibited Website Use

You must not use the ACCCo website:

  • unlawfully;
  • fraudulently;
  • to interfere with website security;
  • to attempt unauthorised access to systems or customer information;
  • to distribute malware or malicious code;
  • to scrape, systematically extract or reproduce substantial website content for commercial purposes; or
  • to infringe ACCCo's or another person's intellectual property rights.

27. Licence Misuse

If ACCCo reasonably believes a resource is being deliberately distributed or used beyond the scope of the licence purchased, ACCCo may contact the purchaser and request that the breach be corrected.

Depending on the circumstances, this may include asking the organisation to:

  • stop unauthorised distribution;
  • remove publicly accessible copies;
  • restrict access to licensed sites;
  • purchase the appropriate additional-site licence; or
  • otherwise remedy the licence breach.

For serious or repeated material breaches, ACCCo may suspend access to delivery systems or terminate the affected licence where permitted by law.

Before taking such action, ACCCo will take into account the nature of the breach and whether it can reasonably be remedied.

Termination does not affect rights or obligations that accrued before termination and does not affect rights that cannot legally be excluded.

28. Privacy

Personal information collected through the ACCCo website, enquiries, purchases and customer communications will be handled in accordance with ACCCo's Privacy Policy and applicable privacy laws.

Payment information may also be processed by third-party payment providers, ecommerce platforms and other service providers involved in completing a transaction.

Customers should review the ACCCo Privacy Policy for further information about how personal information is collected, used, stored and disclosed.

29. Communications

By placing an order, you agree that ACCCo may send communications reasonably necessary to administer the transaction, including:

  • order confirmations;
  • invoices;
  • payment information;
  • licence information;
  • resource delivery emails;
  • download links;
  • customer-service communications; and
  • important notices concerning resources you have purchased.

Marketing communications will be managed separately in accordance with applicable law and available unsubscribe preferences.

30. Promotions and Discount Codes

From time to time, ACCCo may offer discounts, promotional codes or special pricing.

Unless otherwise stated:

  • promotional offers cannot be exchanged for cash;
  • discount codes may have expiry dates or eligibility requirements;
  • only one discount may apply to an order;
  • promotional pricing does not create an entitlement to a retrospective refund for an earlier purchase; and
  • ACCCo may withdraw or correct a promotion affected by an obvious error.

Any specific terms displayed with a promotion also apply.

31. Changes to Resources

ACCCo may improve, update, reformat or discontinue resources over time.

Changes may be made to reflect new evidence, regulatory developments, design improvements, corrections or changes in aged care practice.

Unless expressly included in the original purchase, purchasing a particular version of a resource does not create an automatic entitlement to every future revision or replacement product.

Nothing in this clause affects a purchaser's rights where a supplied product fails to comply with applicable consumer guarantees.

32. Changes to These Terms

ACCCo may update these Terms from time to time to reflect changes to its products, website, business practices or legal requirements.

The current version will be published on the ACCCo website with an updated revision date.

Updated Terms will generally apply to future website use and future purchases from the date they are published.

ACCCo will not retrospectively remove rights already granted under a completed purchase simply by updating these Terms, except where a change is required by law or agreed with the purchaser.

33. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary, where legally possible, without affecting the validity of the remaining provisions.

34. No Waiver

If ACCCo does not immediately enforce a right under these Terms, this does not mean that ACCCo has waived that right.

35. Entire Agreement

These Terms, together with the applicable product description, site licence selected, invoice terms and any other conditions expressly agreed in writing between ACCCo and the purchaser, form the agreement relating to the relevant purchase.

Where ACCCo has expressly agreed to different terms in writing for a particular organisation, those specific written terms will prevail to the extent of any inconsistency.

36. Governing Law

These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws.

The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them, subject to any rights or jurisdiction that cannot lawfully be excluded.
